Limits On Our Liability

If you are buying the products for personal, domestic or household use, then you have the rights and remedies available under the Consumer Guarantees Act 1993 and the following limitation on our liability does not apply.

If you are acquiring the products for the purposes of business, then the guarantees and remedies provided under the Consumer Guarantees Act 1993 are excluded and the provisions of this clause apply.

In no circumstances will Kiwi Disposals be liable to you - whether in contract or tort or under any other legal principle - for any direct, indirect, special, repetitive, incidental, exemplary or consequential damages, or any damages whatsoever arising out of or in connection with your use, inability to use, or performance of the information, services, products and materials available from this Site.

Disclaimer

While every effort is made to keep the information on this Site current, prices and product availability are subject to change and Kiwi Disposals will advise you upon placement of your order if changes have been made during the time since the Site was last updated and your order is posted. You can then either agree to still purchase the products or alternatively we will refund the money you have paid.

Returns Policy

Kiwi Disposals will replace defective products, provided that they are defective and not just because you have changed your mind.

It is your responsibility to ensure you have made the right choice. We will not void any transactions simply because you have made a "wrong choice" or have changed your mind.

Please return your defective goods with a copy of your invoice and a note explaining why you are returning the goods to us.

Ordering

Ordering a product is very easy. Just click on a product and add it to your shopping basket. You then need to follow our payment instructions to purchase the products you choose to buy.

Prices

All product prices displayed at the Checkout include GST as applicable in New Zealand.

All product prices displayed on the Final Purchase Approval page include shipping, packaging & handling charges.

All orders will be delivered by courier. Different products have different delivery times. Most ordered products will be delivered within the number of days specified at the Checkout. Occasionally this time may vary depending on product availability and delivery delays.

If your order is not delivered within the time quoted, please email us with your personal and order details, 24 hours a day.

Kiwi Disposals will do our best to give you a reason for any delay.

International Orders

The delivery time and cost will vary depending on your location. Delivery time will be specified during the Checkout process. Please check our FAQ to establish the destinations/countries we can deliver to.

Cancellation By You Prior To Delivery

You acknowledge that Kiwi Disposals will incur obligations and costs once you place an order with us. Therefore you may not cancel or vary an order once it has been placed with us unless of course Kiwi Disposals advise you that delivery cannot be made due to circumstances beyond our reasonable control.

Use Of Personal Information

Personal information gathered during the process of this transaction will only be used for delivery purposes.

We do however, reserve the right to hold such information for a period of time long enough to ensure that the purchase, packing and delivery has been completed successfully. We DO NOT share your information with any third party, company or organisation and in fact we deplore such activities. We do not store credit card information. This information is handled by our SECURE PAYMENT GATEWAY provider.

Under the provisions of the Privacy Act 1993, you may request access to and correction of your personal information. Requests must be in writing which includes by email. Kiwi Disposals may charge a fee for the reasonable costs incurred in responding to these requests, but will disclose the costs to you before those costs are incurred.

Events Beyond Our Control

Kiwi Disposals will be excused from our obligation to deliver goods within the estimated time if that non-performance is due to events beyond its reasonable control.

Governing Law

Your order and the contract between you and Kiwi Disposals is subject to the law of New Zealand and Kiwi Disposals submit to the exclusive jurisdiction of the courts of New Zealand. The Vienna Convention on the International Sale of Goods does not apply. If you are not located in New Zealand, Kiwi Disposals will not be liable for any breach of foreign legislation, code or directive as a result of you importing any of the products ordered from our Site into your country.
